OFFICIAL GENERAL CONTEST RULES


Grupo Radio Centro LA, LLC, its subsidiaries, and affiliated companies (collectively the “Company”), will conduct periodic on-air and/or Internet contests (each a “Contest” and collectively “Contests”). The Company will conduct Contests on KXOS-FM (93.9 FM) (the “Station”).


SPECIFIC CONTESTS AND RULES: By participating in a Contest, contestants agree to these Official General Contest Rules as well as the specific rules of a Contest, terms and conditions provided for a particular Contest, either in addition to or in place of these Official General Contest Rules. Additional rules specific for a Contest are posted at www.exitos939.com (the “Contests Website Page”). Copies of the rules are available at the Station, 2600 West Olive Ave. 8th Floor, Burbank, California, 9 a.m.-5 p.m., Monday-Friday. Other restrictions may apply.

PRELIMINARY INFORMATION: No purchase necessary. A purchase will not improve chances of winning. Void outside continental United States and where prohibited. Beginning and end dates and times for a Contest are listed on the Contests Website Page (“Contest Period”). All times refer to Pacific Time. Odds of winning are determined by number of eligible entries and a Contest structure.

ELIGIBILITY: Contests are open only to permanent, legal U.S. residents who are physically residing in the following California counties: Los Angeles, Orange, Riverside, San Bernardino, San Diego, Imperial, San Luis Obispo, Kern, Santa Barbara, and Ventura (proof of residency required) and who are 18 years of age or older as of the start of a Contest Period. Officers, directors, and employees of Contest Entities (as defined herein), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter the Contest. “Contest Entities,” as referenced herein, shall include the Company, sponsors and their respective parent, subsidiary, and affiliate companies and administrative, advertising, and promotion agencies and any other entity involved in the development, administration, promotion, or implementation of the Contest. The Company reserves the right to disqualify contestants who do not adhere to these Official General Contest Rules or the specific rules of a Contest. Prizes will not be awarded, even if announced, if a contestant is not eligible in accordance with these Official General Contest Rules or the specific rules of a Contest. Contestants that provide fraudulent entry information will be disqualified.

TO ENTER: Except as otherwise provided in the specific rules of a Contest, entries may be submitted by telephone or via www.exitos939.com. At a minimum, each entry must include a contestant’s first and last name, postal address, e-mail address, daytime telephone number, birth date and/or any additional information that may be required as indicated the specific rules of a Contest. Incomplete entries will be disqualified. All entries become the property of the Contest Entities, which may be used for any purpose whatsoever, without further compensation to a contestant and will not be acknowledged as received. Contestants may enter once during a Contest Period. Multiple entries received from any person beyond this limit will void all such additional entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. An entry constitutes permission (except where prohibited by law) to use an entrant’s name, city, state, likeness, image, likeness, and/or voice for purposes of advertising, promotion, and publicity without additional compensation.

Telephone Entries: If a Contest accepts telephone entries, Contest Entities are not responsible for a contestant’s inability to complete the call during the call-in portion of a Contest whether due to telephone equipment malfunctions; disconnections; busy lines; faulty, mistranscribed, misdirected, or misdialed telephone communications; or other circumstances. Only calls to the designated telephone number will be eligible to win.

Mail Entries: If a Contest accepts mail entries (postal or electronic), Contest Entities are not responsible for the late, misdirected, lost, misplaced, illegible, mutilated or postage-due entries for any reason, including electronic or computer malfunctions that may affect the delivery or content of the entry, nor are they liable for any injury or damage to any c contestant or any other person’s computer or hardware related to or resulting from participating in or downloading any information necessary to participate in a Contest.

Website Entries: In the event a Contest accepts website entries, contestants must accurately complete all required fields or entry will be deemed invalid. Contest Entities shall have no liability for any malfunction of the Internet, exitos939.com, or any other computer-related processor system. The Company is not responsible for any prize offered or any aspect of a Contest appearing on an advertiser’s web banner or hyperlink located on exitos939.com.

RESTRICTIONS AND LIMITATION OF LIABILITY: One entry per person. One winner per household. Void where prohibited by law. Contestants may only win or qualify to win once every thirty (30) days. The Company reserves the right to extend the thirty (30) day rule to the length of any specific Contest. Contest Entities reserve the right to cancel, terminate or modify a Contest if it is not capable of completion as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any kind. The decision(s) of the Company is final. All federal, state, and local laws and regulations apply. Contest Entities assume no responsibility or liability whatsoever for damages, loss or injury resulting from participating in a Contest or acceptance or use of any prize. In consideration of participation in a Contest, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, a contestant, on his/her behalf, and on behalf of his/her heirs, successors or assigns, administrators and personal representatives, do hereby covenant not to sue, fully release and forever discharge the Company, their respective directors, officers, employees, agents, insurers, attorneys, shareholders and representatives, each predecessor, successor, and assign thereof from and against any and all actions, charges, claims, losses, costs, damages, expenses (including attorneys’ fees and expenses) and liabilities of any kind or character, whether known or unknown, in connection with, arising out of or in any way related to your participation in any Contest and/or his/her acceptance, possession, use, or misuse of and prize or any portion thereof.

PRIZES: Prizes are specified within the specific rules of a Contest. Prizes are non-transferable and non-exchangeable. No substitution or cash equivalent will be made. Contest Entities reserve the right to substitute a prize of equal or greater value if the awarded prize in unavailable for any reason. If tickets to a performance are awarded as a prize, Contest Entities are not responsible for any cancellation or rescheduling of the performance for any reason and has no obligation to reimburse, refund or otherwise substitute the tickets for another prize should the performance not be rescheduled or vouchers not issued. Contest Entities are not responsible for cancellations or delays in travel accommodations and has no obligation to reimburse, refund or otherwise substitute any tickets awarded as a part of a travel prize due to such cancellations or delays.

HOW TO CLAIM PRIZE(S): Winners will be selected as described in the specific rules of a Contest. Winners agree to appear at the Station’s studios to claim the prize, unless alternate arrangements are acceptable through the Station’s promotions department. Prizes can be picked up the Station unless otherwise stated in the specific rules of a Contest. Prizes may only be claimed between the hours of 8 a.m. and 5 p.m. Monday-Friday (excluding holidays) unless otherwise directed by the Station. Station may close for other reasons. To make sure prizes may be picked-up, winners are required to call the Station before making any pick up. In the event that a prize is mailed, pursuant to a winner’s prior written consent, winners assume the risk of the prize’s safe arrival. Before any prize(s) will be awarded, winners must provide: proof of age; photo identification (the only accepted types of photo identification are government issued photo identifications, including a valid driver’s license or United States passport); and a valid taxpayer identification number or social security number. The Company reserves the right to deny awarding the prize if a winners fails to provide satisfactory identification, as determined in the Company’s sole discretion. Winners agree to execute an affidavit of eligibility, indemnification and release of liability before any prize is awarded. If the prize is travel tickets, winner’s travel partners, if any, must meet age eligibility requirements and must also execute an affidavit of eligibility, indemnification and release of liability prior to awarding the prize. Failure to execute any of these documents or comply with any of the terms will result in forfeiture of the prize. Winners have thirty (30) days from the date his/her r name is first announced on the air, or by other disclosed mode of public dissemination, to claim and pick up their prize. Failure to claim and pick up prize within this time for any reason will result in forfeiture of the prize. Signing for the prize(s) indicates a winner has received the prize(s), abide by these rules, and the publicity disclaimer. Prize is forfeited upon refusal to sign or provide required information. A winner’s designated representative cannot claim prize(s). The Company reserves the right, in its sole discretion, to award unclaimed prizes to alternate contestants or not to award the unclaimed prizes. All federal, state and local laws and regulations apply. All federal, state and local taxes (including any sales taxes) are your sole responsibility. Prior to the delivery of any prize, the Company reserves the right to collect any taxes it deems appropriate from winners. If any winner win over $600 in prizes during any one year period he/she will receive an IRS form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS. Any additional costs relating to the prizes, and incurred as a result of accepting the prizes, is a winner’s sole responsibility as the winner.

DISQUALIFICATION AND PENALTIES: Contestants agree to be bound by these Official General Rules and the specific rules of a Contest. The Company, in its sole discretion, further reserves the right to disqualify a contestant for: violating any rules; tampering with the entry process or the operation of exitos939.com; gaining an unfair advantage in participating in a Contest; obtaining winner status using fraudulent means; and/or engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior. Furthermore, any resale or auction or attempt to resell or auction of any complimentary prizes, if any, will result in disqualification for all future Contests. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF A CONTEST, TELEPHONE SYSTEMS OR EXITOS939.COM, OR UNDERMINE THE LEGITIMATE OPERATION OF A CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

PUBLICITY RELEASE: Unless prohibited by law, contestants’ and winners’ participation constitutes permission for Contest Entities, without any further obligation to use a contestant’s or winner’s name, voice, biographical data and likeness for promotional purposes.

ADDITIONAL TERMS: The failure of Contest Entities to comply with any provision of these Official Rules or the specific rules of a Contest due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Contest Entities (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules or the specific rules of a Contest. In the event of cancellation, modification, or suspension, the Contest Entities reserve the right to select winners in a random drawing from among all eligible, non-suspect entries received at the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at http://www.exitos939.com.

DISPUTES: The Contest IS governed by, and will be construed in accordance with, the laws of the State of CALIFORNIA, and the forum and venue for any dispute shall be in LOS ANGELES, CALIFORNIA. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in CALIFORNIA. All proceedings brought pursuant to this paragraph will be conducted in LOS ANGELES County. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.



These rules apply to all Company sponsored contests and promotions unless modified or superceded by rules written for a specific Contest, or if inapplicable for such a promotion or Contest. In the event the specific rules of a Contest conflict with any of these general rules provided above, the specific rules of a Contest prevail. The Company reserves the right in its sole discretion to supplement or make changes to the rules of any Contest at any time without notice. The Company reserves the right in its sole discretion to interpret the rules of any Contest, and such interpretation shall be binding upon all contestants. The Company shall not be responsible for any administrative errors involved in the execution of any Contest. Copies of the rules for any Contest may also be obtained by sending a self-addressed stamped envelope with the identity of the Contest inquiry to the Station.

WINNERS LIST: For a list of contest winners, send a self-addressed, stamped envelope to EXITOS 93.9, KXOS-FM, 2600 West Olive Ave. 8th Floor, Burbank, California, and include the name of the specific Contest.
